Delinquent Neighbor 2026: New Deadlines for Spanish HOA Debt Recovery

Spain's Ley 1/2025 introduced mandatory pre-litigation mediation (MASC) before communities can file a payment order (proceso monitorio) against a delinquent owner. Communities that skip this step will have their claim rejected. The total recovery timeline has increased by approximately 2 months.

Key change — Ley 1/2025: Before filing a monitorio, the community must demonstrate an attempt at extrajudicial resolution via MASC (mediation or conciliation). If the delinquent owner doesn't attend or no agreement is reached, the community obtains a certificate of failed attempt and can proceed to court. Statute of limitations: 5 years (Spanish Civil Code Art. 1966.3).
