The president of a Spanish community of owners receives no pay, spends their free time managing neighbours' problems, and in many cases does not know exactly what they can and cannot do. Yet under the LPH they carry very specific legal responsibilities that can have serious consequences if not fulfilled.

The 8 responsibilities of the president under the LPH

01

Legal representation of the community

The president signs contracts, lawsuits, and any document on behalf of the community. Without their signature, the community cannot litigate or enter contracts.

Convene and chair meetings

Calls the annual ordinary meeting and any extraordinary meetings needed. Chairs the meeting and maintains order during debates.

Execute meeting agreements

Once an agreement is passed, the president must ensure it is carried out. They can delegate to the property manager but retain supervisory responsibility.

Act on emergencies

For urgent damage to common areas, the president can order works without a prior meeting. They must then call a meeting to ratify the decision.

Enforce the bylaws

If a neighbour breaches the bylaws, the president can issue a written warning and, if the breach continues, initiate legal proceedings (art. 7.2 LPH).

Recover debts from defaulters

The president can file payment order proceedings to collect unpaid fees, with prior authorisation from the meeting or property manager.

Supervise the property manager

The property manager works under the president's supervision. If they act irregularly, the president can propose their dismissal to the meeting.

Safeguard documentation

Must have access to and ensure the preservation of minutes, bylaws, title deeds and financial records.
