Scotland uses a different legal framework. The Tenements (Scotland) Act 2004 establishes the Tenement Management Scheme (TMS) as a default where there's no deed of conditions. Under TMS r.3.1, maintenance decisions are by majority of owners. If an owner refuses to pay their share, you can raise a summary cause action in the Sheriff Court for their proportion.
