Homeowners Association President Functions in Spain: What They Can and Cannot Do
## Homeowners Association President Functions in Spain: What They Can and Cannot Do The president is the face of the homeowners association. They sign contracts, represent the community before third parties and can take urgent decisions without calling a meeting. But their powers have clear limits. --- ### Who Can Be President? Under **art. 13.2 LPH**, the president must be an owner of a unit in the community. The role is mandatory: if no owner volunteers, it is assigned by rotation or lottery. --- ### What the President CAN Do 1. **Represent the community** before courts, public administrations and third parties (art. 13.3 LPH). 2. **Call meetings** — both ordinary AGMs and extraordinary meetings (art. 16.1 LPH). 3. **Chair meetings** and manage the proceedings. 4. **Act in urgent situations** without prior AGM approval (art. 10.1 LPH), subject to later ratification. 5. **Execute AGM resolutions**. --- ### What the President CANNOT Do Without an AGM Resolution - Approve improvement works or modifications to common elements. - Hire or dismiss the property manager. - Approve special assessments or modify the annual budget. - Amend the community bylaws. - Sign loans on behalf of the community. --- ### Can the President Be Personally Liable? Yes — if they act outside their powers and cause damage, omit urgent action when a known risk exists, or sign fraudulent contracts. --- *Is your community president overwhelmed with owner queries?
